Short Version

  • If you abuse our services, we have the right to disable your account.

General

When you choose to use the Words Across America™ mobile app and website ("Services"), you are agreeing to all of the terms and conditions of this Agreement between you and POMDP, Inc. ("The Company"). The Company may change, add or remove portions of this Agreement at any time, but if it does so, it will post such changes on both Services. The Company may change, suspend or discontinue any aspect of the Services at any time, including the availability of any Services' feature or content. The Company may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.

Content

All materials published in the Services (including, but not limited to the database, photographs, images, illustrations, audio clips and video clips, also known as the "Content") are protected by copyright, and owned or controlled by The Company or the party credited as the provider of the Content. You shall abide by all additional copyright notices, information, or restrictions contained in any Content accessed through the Services. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create new works from, distribute, perform, display, or in any way exploit, any of the Content or the Services in whole or in part.

Restrictions

The following restrictions apply to the use of the Services:

You shall not create an account or access the Services if you are under the age of 13. You shall restrict use by minors, and you will deny access to children under the age of 13. You accept full responsibility for any unauthorized use of the Services by minors. You are responsible for any use of your credit card or other payment instrument (e.g. paypal) by minors. You shall not have more than one account at any given time, sell or give away your account, create an account using a false identity or information, or on behalf of someone other than yourself. You shall use your account only for non-commercial purposes. You shall not use the Services to advertise, or solicit, or transmit any commercial advertisements, including chain letters, junk or spam e-mail or repetitive messages

Agreements

You agree that you will not, under any circumstances:

  • Engage in any act that The Company deems to be in conflict with the spirit or intent of the Services or make improper use of The Company’s Services.
  • Use cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software designed to modify or interfere with the Services. Disrupt, overburden, or aid or assist in the disruption or overburdening of any computer or server (“Server”) used to offer or support the Services.
  • Institute, assist, or become involved in any type of attack, including without limitation distribution of a virus, denial of service attacks upon the Services, or other attempts to disrupt the Services or any other person’s use or enjoyment of the Services.
  • Attempt to gain unauthorized access to the Services, accounts registered to others or to the computers, Servers, or networks connected to the Services by any means other than the user interface provided by The Company.
  • Post any information that is abusive, threatening, obscene, defamatory, libelous, or racially, sexually, religiously, or otherwise objectionable or offensive. Post any information that contains nudity, excessive violence, or offensive subject matter or that contains a link to such content.
  • Attempt to, or harass, abuse, or harm, or advocate or incite harassment, abuse, or harm of another person, group, including The Company employees, including The Company’s customer service representatives.
  • Make available through the Services any material or information that infringes any copyright, trademark, patent, trade secret, right of privacy, right of publicity, or other right of any person or entity or impersonates any other person, including without limitation a The Company employee.
  • Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for any underlying software or other intellectual property used to provide the Services or any The Company game, or to obtain any information from the Services or any The Company game using any method not expressly permitted by The Company.
  • Solicit or attempt to solicit personal information from other users of the Services or any The Company game or collect or post anyone’s private information, including personally identifiable information (whether in text, image or video form), identification documents, or financial information through the Services.
  • The Company reserves the right to remove or reclaim any usernames at any time and for any reason.
  • The Company reserves the right to determine what conduct it considers to be in violation of the rules of use or otherwise outside the intent or spirit of these Terms of Services or the Services themselves. The Company reserves the right to take action as a result, which may include terminating your account and prohibiting you from using the Services.

Account Access

You shall not share the account or the Login Information, nor let anyone else access your account or do anything else that might jeopardize the security of your account. You are solely responsible for maintaining the confidentiality of the Login Information, and you will be responsible for all uses of the Login Information, including purchases, whether or not authorized by you. You are responsible for anything that happens through your account.

Disclaimers

The performance of the Services and all information contained on, downloaded or accessed from this site are provided to you on an "As Is" basis, without warranties of any kind whatsoever, including any implied warranties or warranties of merchantability, fitness for a particular purpose or non-infringement of the rights of third parties. The Company shall be not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, Internet access providers, computer equipment, software, or any combination thereof including any injury or damage to your or any other person's computer as a result of using the Services. The Company reserves the right, at its sole discretion, to modify, disable access to or discontinue, temporarily or permanently, any part or all of the Services or any information contained thereon without liability or notice to you. As a user of The Company's Services, you acknowledge and agree that any reliance on or use by you of any information available on the Services shall be entirely at your own risk. In no event shall The Company nor any of its data providers be liable for any direct, indirect, consequential or exemplary damages arising from the use or the performance of the Services, even if The Company or such provider has been advised of the possibility of such damages.

In-game Achievements Disclaimer

The game's depicting of awards and achievements is for entertainment purposes only. They have no real value, no implied monetary value and are non-redeemable. The Company is under no obligation to produce anything of real-world value for the awards depicted in the game.

The Services contains links to other related World Wide Web Internet sites and resources. Since The Company is not responsible for the availability of these outside resources, or their contents, you should direct any concerns regarding any external link to the site administrator or Webmaster of such site.
